Proposed Increase to the New York State Minimum Wage

The New York State Department of Labor (“NYSDOL”) has proposed a rule to increase the minimum wage, effective on and after December 31, 2022, from $13.20 to $14.20 in locales outside of New York City, Nassau, Suffolk and Westchester counties.

A copy of the proposed rule as published by the NYSDOL in the New York State Register is attached here to. The proposed increase will impact many employers outside of New York State, including those employers covered by the Wage Orders applicable to Miscellaneous Industries, Nonprofit Making Institutions that have not elected to be exempt from coverage, the Building
Service Industry, the Hospitality Industry and to Farm Workers. While the rule is not final, employers should be aware of the proposed increase to the minimum wage to anticipate the increase to employee wages and to prepare for the budgetary impact of same.

Public comments on the proposed rule will be received by the NYSDOL until December 12, 2022. Hinman Straub will continue to monitor the proposed rule and provide any updates as
