Court of Appeals OKs Special Prosecutor in WFP Case

The Court of Appeals, the state’s highest court, has unanimously approved the appointment of a special prosecutor to investigate the Working Families Party’s (WFP’s) involvement in a 2009 Staten Island election.

The case arose out of possible Election Law, campaign finance and criminal violations in the race. Daniel Donovan, Staten Island District Attorney (R), began the probe. He then asked – in a sealed application — the Deputy Chief Administrative Judge for the New York City Courts to appoint a special prosecutor.

After the special prosecutor issued subpoenas to WFP and Citizen Action of New York. The WFP sued to unseal Donovan’s application and quash the special prosecutor’s subpoenas.

Today’s decision means that the special prosecutor will be able to move forward with the investigation.
