Kristin Foust is a member of the firm’s Labor and Employment Department. Since joining the firm in 2018, she has provided comprehensive legal representation and strategic counsel to clients navigating complex labor and employment matters.
Ms. Foust represents clients in Federal and State Courts on claims involving workplace discrimination, retaliation, and wage and hour violations. She also advocates for clients before administrative agencies such as the Equal Employment Opportunity Commission (EEOC) and the New York State Division of Human Rights (NYSDHR) on discrimination-related issues. She conducts employee anti-harassment and anti-discrimination training, reviews employer handbooks and policies for legal compliance, and drafts employment agreements, independent contractor agreements, and non-compete agreements to ensure enforceability. Additionally, Ms. Foust assists employers in navigating internal complaints, including conducting investigations. She also represents clients in audits conducted by the United States Department of Labor and the New York State Department of Labor. Ms. Foust also provides counsel to employees regarding their separation from employment, including review and negotiation of severance packages and separation agreements.
Ms. Foust’s expertise extends to representing public sector clients—both employers and employees—in Civil Service Law Section 72 and 75 disciplinary matters. She is skilled in negotiating collective bargaining agreements for municipal employers and is well-versed in the Civil Service Law, Taylor Law, and General Municipal Law §§ 207-a and 207-c. Additionally, she assists clients with filing for disability retirement benefits to the New York State and Local Retirement System as well as the Police and Fire Retirement System, and represents clients at redetermination hearings before the New York State Comptroller’s Office.
Before joining Hinman Straub, Ms. Foust spent over a decade as an Assistant District Attorney in both the Manhattan District Attorney’s Office and the Saratoga County District Attorney’s Office. During this time, she prosecuted a wide range of criminal offenses from arrest through sentencing, gaining extensive litigation experience through grand jury proceedings, misdemeanor and felony trials, investigations, and appeals.
Originally from Dix Hills, New York, Ms. Foust enjoys playing tennis and being with her family during her spare time.
