Federal Judge Strikes Down New York’s Cap on SuperPAC Donations

Earlier today, a federal judge in Manhattan found that New York’s limits on contributions to independent expenditure groups is unconstitutional.

Reuters is reporting that District Judge Paul Crotty has “reluctantly” struck down New York State’s $150,000 per year limit on donations to independent political action committees, citing McCutcheon v. FEC.

Read my earlier blog posts on the issue from when the case was filed last September, and from when the Second Circuit blocked enforcement of the state’s limits in last October. Also, read my blog post on the likely impact McCutcheon in New York.

In the wake of this ruling, donors are no longer limited in the amount that they can give to Super PACs. Political committees that coordinate with parties or candidates remain subject to state-imposed limits.
